T2-129 „Dėl Dariaus Juodaičio atleidimo iš Jurbarko rajono savivaldybės administracijos direktoriaus pavaduotojo pareigų“ 2019 m. balandžio 17 d. administracijos direktoriaus pavaduotojas buvo atleistas iš Jurbarko rajono savivaldybės administracijos direktoriaus pavaduotojo pareigų pasibaigus savivaldybės tarybos įgaliojimų laikui.Vietos savivaldos įstatymo 16 straipsnio 2 dalies 9 punktas numato išimtinė savivaldybės tarybos kompetenciją – savivaldybės administracijos direktoriaus (savivaldybės administracijos direktoriaus pavaduotojo) priėmimas į pareigas ir atleidimas iš jų; <...> savivaldybės administracijos direktoriaus ir savivaldybės administracijos direktoriaus pavaduotojo darbo užmokesčio nustatymas.Vietos savivaldos įstatymo 29 straipsnio 3 dalyje nustatyta, kad savivaldybės administracijos direktoriaus pavaduotojas (pavaduotojai) į pareigas skiriamas (skiriami) savivaldybės administracijos direktoriaus siūlymu mero teikimu savivaldybės tarybos sprendimu politinio (asmeninio) pasitikėjimo pagrindu.Valstybės tarnybos įstatymo 10 straipsnio 2 dalies 7 punkte nustatyta, kad savivaldybės administracijos direktoriaus pavaduotoją į pareigas priima savivaldybės taryba. Valstybės tarnybos įstatymo 29 straipsnio 1 dalis numato, kad valstybės tarnautojo pareiginė alga nustatoma pagal šio įstatymo 1 priede valstybės tarnautojo pareigybei nustatytą pareiginės algos koeficientą arba iš pareigybei nustatyto pareiginės algos koeficientų intervalo. Jeigu pareiginė alga nustatoma iš pareigybei nustatyto pareiginės algos koeficientų intervalo, pareiginę algą nustato valstybės tarnautoją į pareigas priimantis asmuo. Šio įstatymo 1 priedo „Lietuvos Respublikos valstybės tarnautojų pareigybių pareiginių algų koeficientai“ 5 punkte nurodytas savivaldybės administracijos direktoriaus pavaduotoj pareiginės algos koeficiento intervalas – 9,5–17 (baziniais dydžiais), kadangi Jurbarko rajono savivaldybės administracija priskiriama III įstaigų grupei. Valstybės tarnybos įstatymo 30 straipsnio 2 dalyje numatyta, kad valstybės tarnautojams priedą už tarnybos stažą sudaro vienas procentas pareiginės algos už kiekvienus tarnybos Lietuvos valstybei metus. Šio priedo suma negali viršyti 30 procentų pareiginės algos.Korupcijos prevencijos įstatymo 9 straipsnio 8 dalyje nustatyta, kad į savivaldybių įstaigų vadovų ir jų pavaduotojų pareigas asmuo gali būti paskirtas tik gavus ir įvertinus informaciją iš Specialiųjų tyrimų tarnybos. Yra gautas Lietuvos Respublikos specialiųjų tyrimų tarnybos 2019 m. balandžio 18 d. raštas Nr. 4-01-3842, pateiktas tarybos nariams el. paštu.Jurbarko rajono savivaldybės tarybos veiklos reglamento, patvirtinto Jurbarko rajono savivaldybės tarybos 2015 m. rugsėjo 24 d. sprendimu Nr. T2-255 „Dėl Jurbarko rajono savivaldybės tarybos veiklos reglamento patvirtinimo“ (toliau – Reglamentas) 41 punkte numatyta, kad <...> savivaldybės administracijos direktoriaus pavaduotojas į pareigas administracijos direktoriaus siūlymu mero teikimu skiriamas tarybos sprendimu politinio (asmeninio) pasitikėjimo pagrindu.Reglamento 1381 punktas numato, kad meras šio reglamento nustatyta tvarka teikia tarybai <...> savivaldybės administracijos direktoriaus pavaduotojo (savivaldybės administracijos direktoriaus siūlymu), <...> kandidatūras <...>. Šie mero teikimai ir siūlymai įforminami žodžiu arba raštu.3. Kokių pozityvių rezultatų laukiama.Bus įgyvendinti teisės aktų reikalavimai – paskirtas administracijos direktoriaus pavaduotojas.4. Galimos neigiamos priimto projekto pasekmės ir kokių priemonių reikėtų imtis, kad tokių pasekmių būtų išvengta.Nenumatoma.5. Kokie šios srities aktai tebegalioja (pateikiamas aktų sąrašas) ir kokius galiojančius aktus būtina pakeisti ar panaikinti, priėmus teikiamą projektą.Paskyrus administracijos direktoriaus pavaduotoją tikslinga peržiūrėti sprendimus, susijusius su įvairių komisijų, darbo grupių, kurių nariu yra administracijos direktoriaus pavaduotojas, veikla, ir esant poreikiui juos pakeisti.6. Projekto rengimo metu gauti specialistų vertinimai ir išvados, ekonominiai apskaičiavimai (sąmatos), konkretūs finansavimo šaltiniai.Pareiginė alga apskaičiuojama atitinkamą pareiginės algos koeficientą dauginant iš bazinio dydžio, kurį nustato Lietuvos Respublikos valstybės politikų, teisėjų, valstybės pareigūnų, valstybės tarnautojų, valstybės ir savivaldybių biudžetinių įstaigų darbuotojų pareiginės algos (atlyginimo) bazinio dydžio, taikomo 2019 metais, įstatymas (2018 m. gruodžio 11 d. Nr. XIII-1713). Nuo 2019 m. sausio 1 d. bazinis dydis yra 173 Eur. Savivaldybės administracijos direktoriaus pavaduotojo pareiginės algos koeficiento intervalas – 9–17 (baziniais dydžiais), todėl apskaičiuota pareiginė alga gali būti nuo 1643,5 iki 2941 eurų. Priedą už tarnybos stažą sudaro vienas procentas pareiginės algos už kiekvienus tarnybos Lietuvos valstybei metus. Šio priedo suma negali viršyti 30 procentų pareiginės algos.7.
